What is a probate loan?

The probate loans described here are bridge loans secured by real estate, used for an heir buyout, an inherited mortgage payoff, or eligible estate needs. Credit is not part of qualification for these equity-based programs. The lender still reviews available equity, title, the proposed use of funds, and a workable repayment plan. Open probate does not automatically prevent a review, but your attorney and title team must confirm ownership, authority to borrow, and any required approvals before a loan can close.

Estate loans to buy out siblings

One heir may want to keep the home while others want their agreed shares paid out. An estate loan may fund that buyout if equity, title, legal authority, and the repayment plan support the transaction. How to work out the sibling buyout amount →

Inherited home with arrears

An inherited mortgage can still face foreclosure when payments are missed. Financing may help address the existing debt if the property and transaction qualify. Start with the servicer’s current figures and your attorney’s review of any court deadline. What to do about missed payments →

Estate expenses & carrying costs

Taxes, insurance, association dues, repairs, and estate administration can create a funding need. Whether property equity can cover a particular expense depends on the lender’s program and the estate’s legal authority.

Out-of-state heirs

When heirs disagree

Financing may support an agreed buyout, but it cannot settle an ownership dispute. Ask your attorney to resolve the rights and consent of the parties before treating a loan as the solution.

Plan how the bridge loan will be repaid

Bridge terms run up to 36 months in most cases, with no pre-payment penalty. The repayment plan may involve a refinance if you qualify, a sale, or other verified funds. A conventional refinance is not automatic when probate closes, and its requirements are separate from the equity-based bridge program.

Keeping the family home

What an heir buyout loan needs to solve

The family’s agreed buyout and the property’s existing debt both matter. An estate loan should be reviewed against the entire transaction.

  • The family agreement: who will keep the home and what the other heirs have agreed to receive.
  • The existing mortgage: whether it will remain or be paid off as part of the proposed transaction.
  • Ownership and authority: who holds title and who can sign, as confirmed by the attorney and title team.
  • The repayment plan: how the new loan will be serviced and paid off; a future refinance requires separate qualification.

Taking over an inherited mortgage does not itself pay co-heirs. If your only need is to continue the existing loan, speak with the servicer before replacing it. If you need funds for an agreed buyout, the sibling buyout guide explains the distinction.

Inherited home · Missed mortgage payments

Inherited a Florida house that is behind on payments?

Start by separating the mortgage problem from the ownership paperwork. Inheriting a home does not, by itself, mean you must replace the existing mortgage. A new loan should solve a specific financing need.

1. Get the servicer’s current information

Ask the mortgage servicer what documents it needs to confirm your status as a successor in interest. Ask about the current account balance, missed payments, and options for the existing loan. CFPB guidance for inherited mortgages.

2. Confirm who can authorize the transaction

Your Florida probate attorney and title team review the deed, estate or trust documents, ownership interests, and any required court orders. Homestead and estate rules can affect who has authority to act. The Florida Bar’s probate guide explains the roles involved.

Before the first call

A short checklist for your financing review

Bring what you have. You can call before every document is available.

  • Property: Florida address, current use, and known condition issues.
  • Mortgage and other debt: latest statement, any payoff or reinstatement quote, and known tax or association balances.
  • Estate status: whether probate is open, who represents the estate or trust, and your attorney’s contact details.
  • Family plan: who wants to keep the home, whether a buyout is agreed, and what still needs to be resolved.
  • Notices: any foreclosure papers or scheduled sale date for your attorney to verify.
  • Repayment: whether the plan involves a future refinance, sale, or other funds.

Honest answers

Probate financing questions, answered

Can I get a loan on a house in probate in Florida?

Possibly. The equity-based probate programs described here can be reviewed while an estate is open. Before closing, the lender, your attorney, and the title team must confirm acceptable equity, ownership, authority to borrow, any required approvals, and a repayment plan. Open probate alone does not establish eligibility.

How does an estate loan help me buy out siblings?

An estate or heir buyout loan can use available property equity to pay co-heirs under an agreed transaction. Existing debt and the proposed buyout affect how much financing is needed. The attorney and title team confirm ownership and the required parties; the lender reviews the loan. A buyout is not automatically better than selling.

What if the inherited home has missed mortgage payments?

Ask the servicer about the existing mortgage and the documents needed to confirm your status as a successor in interest. Have your attorney review foreclosure papers or a sale date. Equity-based financing may address the mortgage debt if the property and transaction qualify, but an application does not pause foreclosure or guarantee funding.

Is credit part of qualification for these probate loans?

Credit is not part of qualification for these equity-based probate and foreclosure programs. The lender reviews the property, available equity, title, use of funds, loan structure, and repayment plan. A separate conventional or other mortgage program has its own qualification requirements.

Can probate loans be refinanced?

A refinance can be an exit strategy if ownership, title, and the borrower meet the new lender’s requirements at that time. It is not guaranteed by closing probate. Bridge terms are up to 36 months in most cases, with no pre-payment penalty. The plan may instead involve selling the property or repaying from other verified funds.
